The Artificial Intelligence Evaluation Platform ("Platform") is operated by Türkiye Metal Sanayicileri Sendikası ("MESS") and all rights belong to MESS. Use of the Platform by members ("Member") – and, to the extent applicable, visitors to the Platform shall also be considered Members under these Terms of Use – is subject to the following terms and conditions. Please read these Terms of Use ("Terms of Use") carefully before using the Platform.
By accessing, viewing, or using the Platform, you acknowledge that you have read and understood these Terms of Use and that you agree to be bound by their provisions and conditions.
The Platform is open to everyone, provided it is used in accordance with the law and these Terms of Use.
Including but not limited to the content published on the Platform, no element available on the Platform may be published on any other websites and/or platforms in written, oral and/or electronic form or in any manner whatsoever without MESS's prior consent, nor may it be used in a way that directly or indirectly competes with MESS.
The term "Member" refers to the natural person whose access and use rights to the Platform are established through the registration processes carried out through the membership form or similar methods, whose membership is approved by the Company, and who acts in the capacity of an employee, officer, or representative of the legal entity for that they are an employee or which they represent.
The Platform operates strictly on a membership basis, and non-members cannot benefit from the Platform. Upon completion of the membership process, Members gain access to analysis panels created specifically for the legal entity they represent, as well as artificial intelligence powered assessment outputs and sectoral comparison and guidance reports.
MESS is the owner or license holder of the Platform's overall appearance and design, as well as information, images, MESS trademarks and domain name, logos, icons, demonstrative, written, electronic graphic or machine-readable technical data, computer software, the sales system applied, business method and business model, and all other materials ("Materials") on the Platform, together with all related intellectual and industrial property rights, and the Materials are legally protected.
The Member agrees to keep confidential any and all information of a commercial, financial, legal, technical, or other nature that they obtain directly or indirectly, in writing, verbally, electronically, or in any other form, in connection with the Platform and related services provided by MESS under these Terms of Use and not to disclose it to third parties without the prior written consent of MESS.
MESS shall not be liable for any direct or indirect damages arising from accessing the Platform or using the Platform or the information, data, programs, etc. on the Platform. Within the scope of the Platform's security, user data and system integrity are protected, and end-to-end encryption techniques are applied.
The following events, including but not limited to, occurring beyond the control of the Parties and preventing and/or delaying the Parties from fulfilling their obligations under these Terms of Use shall be considered force majeure events.
These Terms of Use shall enter into force on the date they are announced by MESS on the Platform. The Member shall be deemed to have accepted these Terms of Use upon approval. MESS may amend the provisions of these Terms of Use at any time, and such amendments shall enter into force immediately upon being published on the Platform, without any notice and/or acceptance, by the Member's access to and use of the amended Terms of Use.
